The winner of the first running of the Single Biggest IDIOT on Earth Award (a.k.a. King of the RINO) has been selected.

In the face of growing child support arrearages due to widespread paternity fraud, one man decided to make paternity fraud legal and provide direct financial incentives for adultery. His name is Senator Steve Johnson (R-15 Colorado). Senator Johnson sponsored a bill which is now law in Colorado that forbids the use of DNA testing after a separation or divorce has been made final or after a child support order has been entered if unmarried. Please do be polite if you write him but it is worthwhile to point out that he and his ilk are the ones doing harm to children, marriage, families, as well as the Grand Old Party in Colorado and the nation.

Over 300,000 DNA paternity tests are done yearly and consistently 30% of such tests show the named man is not the father of the child in question. Adultery is grounds for divorce and having another man's child is physical evidence of adultery!

This Senator somehow figured making it legal to have a child by someone other than your husband while you're married is going to resolve this problem. Only a "Class A Blithering Idiot" could think this makes sense. We urge everyone on earth to write to Senator Johnson and explain this simple fact of life to him.

It is clear that Senator Johnson does need a great deal of guidance regarding a bill he sponsored and was allegedly a part of writing. The following email exchange is between Senator Johnson and Colorado's Democratic Speaker Pro Tempore, Representative Cheri Jahn (D-24 Colorado). In the exchange Senator Johnson had to ask a Democrat to explain the bill he allegedly sponsored and was allegedly a part of writing.

They called while I was out of my office.  We did not change "law"--you
started this in the senate andif you recall it simply put in statute 
FIVE different times we may take the opportunity to tell a  man going 
through child custody hearings that if he is going to dispute this 
NOT to wait 3 - 5 years as that IS very disruptive to a child's world.
SO--because so many kept saying "I did not know I should dispute 
paternal DNA findings" we put in our statutes five places where we 
must tell them and bring the urgency to their attention.

No, It's fact. He IS the biggest Idiot on Earth.

Senator Johnson then goes about trying to convince people that everyone on earth is either a liar or an idiot, except for him of course. He does this via a comparison table (sent as an attachment in his emails) produced by the Colorado State Department of Human Services. Note in his email to concerned citizens he writes, "We DID NOT change current law on the DNA" while at the same time providing them with a government produced document that shows clear evidence that he in fact has. The bill doesn't prohibit DNA information, in fact, We DID NOT change current law on the DNA--we only ADDED more opportunities to where men should be informed because once was insufficient. 
It is unfortuante your email group isn't more informed before they spread lies,  They are really hurting our case.

In another email exchange with a concerned citizen, Senator Johnson continues to supply proof that he did in fact change the Law in Colorado while claiming he did not. But worse, he completely evades the concerned citizen's questions. The font changes in the Senator's email below are exactly as they were in the original, which begs the question; how many people does it take to help him try to explain a law he allegedly wrote?

Cindy asked me to forward the side-by-side the Department prepared for SB 05-181.  This gentleman certainly has the bill all wrong,.  Of course, it doesn't help that the Post printed an article that is factually inaccurate.  As you may recall, the bill was very carefully crafted to give advisements to the father with respect to genetic testing, but certainly did not outlaw genetic testing as both the Post and these people have asserted.  The Post is merely wrong..

Attached to this email is a comparison of the law before and after SB181 showing the additional opportunities for DNA testing notification to be given early in the process.

I think this is an improvement over current law, it may not be everything you would like to see (by the way, I supported Rep. Sinclair's earlier bill requiring DNA testing to establish paternity).

If this clarifies things, can you help by forwarding this so the obscene emails I am receiving can at least contain informed responses..?  Thanks!!

Can someone please tell me how making it illegal to do DNA testing is going to protect a child? What they are doing is making that child grow up living a lie. What happens when that child needs blood, or is diagnosed with a fatal disease and it is determined that the child’s father is not their father at all? What happens when the father this child has always known cannot help? Why in the world would someone want to do that to children?

The fact is, under SB05-181 it is now impossible for a man to stop paying support for a child that DNA testing determines isn't his after a divorce is final or after a child support order has been entered if unmarried. Further, in this bill C.R.S. § 19-4-111 does not require rules of evidence to be observed in pretrial hearings and a record is kept only if requested. Senator Johnson and company appear to be blindly ignorant of how divorces and separations work in Colorado and SB05-181 simply makes a bad situation worse.

A much more intelligent approach would have been to require DNA paternity testing for every child before a judge could require a man to provide support for that child. Any other approach is legislated indentured servitude at best and slavery at present.

There was brief discussion with Colorado's Senator Ed Jones about your bill and the effects as described. Perhaps Senator Jones, who by the way is a statesman, gentleman and a gentleman of color, can explain to you why slavery is a bad thing and how you've facilitated and legalized it together with adultery?

Then there is the interesting definition for jurisdiction which suggests Senator Johnson and his co-sponsors have little idea how human reproduction occurs. In Section 4 of this bill § 19-4-109(2) C.R.S. is amended to read (in part):

"Jurisdiction - venue: A person who has sexual intercourse in this state thereby submits to the jurisdiction of the courts of this state as to an action brought under this article with respect to a child who may have been conceived by that act of intercourse."

It is a well established fact is that there are a lot of pregnancies that have occurred without sexual intercourse -- virgo intacto pregnancies, In Vitro Fertilizations to name a few ways. Maybe Senator Johnson and company deliberately meant to exclude such births? There are a lot of females that have gotten pregnant engaging in "outercourse," without penetration and in at least one known case with her panties still on. So here we have more opportunity for judges to legislate from the bench because of bad law.

What about all the tourists who come to Aspen each year and party with a bunch of swingers, none of whom are residents of Colorado? Does Colorado retain jurisdiction 9 months later in whatever state a women who "who has sexual intercourse in this state" and her consorts went back to? If so, can she return to Colorado to bring a paternity suit against the alleged father?

SB05-181 lays out a blueprint on how to fake a hearing notice that even a grade school dropout shouldn't have much trouble with and provides a mere ten day window for the man to respond. That is hardly enough time for anyone to discover the problem, never mind dealing with it. But best of all, thanks to this bill -- C.R.S. § 19-4-111 not requiring rules of evidence to be observed in pretrial hearings -- there is no requirement to produce proof a baby even exists.

One must wonder whether SB05-181 a bad joke or have Senator Johnson and company deliberately set out to further enrich the legal profession?

  • Today only about 15 of every 100 children are born into and reach age 18 in an intact family whose parents are married.

  • 35 out of every 100 children are born out of wedlock (and the percentage is much higher in some communities).

  • 30 of every 100 paternity tests will show the man named is not the father of the child in question.

  • Perjury is virtually never punished and subornation of perjury is commonplace.

and so on. Into that milieu Senator Johnson has made it easier and financially rewarding for a woman to commit adultery and commit paternity fraud without any possible punishment. Moreover, under SB05-181 it becomes impossible for a man to even stop such fraud once it is discovered.

Someone needs to explain to Senator Johnson the GOP's own polls show that that MEN are losing faith in the Republican party and it is acts like this that are the primary reason.

The first runner up for the award was Colorado State Representative Debbie Stafford, for her efforts in leading the reform of the state's Domestic Violence laws even though she is a Domestic Violence treatment provider. Can you spell Conflict of Interest?

With people like Senator Johnson and State Representative Debbie Stafford representing the GOP, they should just wave a white flag and surrender the Colorado legislature and governorship to the Democrats. Such actions as these are surely casting doubt on the intelligence and integrity of all Republicans.
